These Terms of Service ("Terms") govern your access to and use of the websites, applications, and related services (collectively, the "Service") provided by Sweeper Lab ("Sweeper Lab," "we," "us," or "our"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. Eligibility and accounts
You must be at least the age of majority in your jurisdiction to use the Service. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You agree to provide accurate registration information and to notify us promptly of any unauthorized use.
2. The Service
Sweeper Lab provides software and tools that may include artificial intelligence ("AI") features for content generation, automation, and related workflows. We may modify, suspend, or discontinue parts of the Service with reasonable notice where practicable. We do not guarantee uninterrupted or error-free operation.
3. Subscriptions, fees, and trials
Paid plans, usage limits, and billing terms are presented at checkout and in your account. Fees are charged in advance for the applicable billing period unless otherwise stated. Taxes may apply. If you participate in a trial, you may be charged when the trial ends unless you cancel in accordance with the cancellation terms presented at signup.
4. Acceptable use
You agree not to:
- Use the Service in violation of law or third-party rights, including intellectual property, privacy, and publicity rights.
- Attempt to probe, scan, or test the vulnerability of the Service, or breach security or authentication measures.
- Reverse engineer, decompile, or disassemble the Service except where prohibited by applicable law.
- Use the Service to generate or distribute unlawful, defamatory, harassing, fraudulent, or harmful content, including content that infringes others' rights.
- Resell, sublicense, or redistribute the Service without our prior written consent.
5. Customer content and license
You retain ownership of content you submit to the Service ("Customer Content"). You grant Sweeper Lab a non-exclusive, worldwide license to host, process, transmit, and display Customer Content solely to provide, maintain, secure, and improve the Service and as required by law. You represent that you have the rights necessary to grant this license.
6. AI outputs
Outputs generated by AI may be inaccurate or incomplete. You are responsible for reviewing outputs before use, especially in regulated or high-risk contexts. We do not warrant that outputs will meet your requirements or be fit for a particular purpose.
7. Intellectual property
The Service, including software, branding, and documentation, is owned by Sweeper Lab and its licensors and is protected by intellectual property laws. Except for the limited rights expressly granted in these Terms, no rights are transferred to you.
8. Confidentiality
If we disclose non-public information to you in connection with the Service, you will use reasonable care to protect it and use it only as permitted. Our use of personal data is described in our Privacy Policy.
9. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, SWEEPERLAB DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
10. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, SWEEPERLAB AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL. OUR AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID TO SWEEPERLAB FOR THE SERVICE IN THE TWELVE (12) MONTHS BEFORE THE CLAIM OR (B) ONE HUNDRED U.S. DOLLARS (USD $100), IF YOU HAVE NOT HAD ANY PAYMENT OBLIGATIONS.
11. Indemnity
You will defend and indemnify Sweeper Lab against any claims, damages, losses, and expenses (including reasonable attorneys' fees) arising from your Customer Content, your use of the Service in breach of these Terms, or your violation of law or third-party rights.
12. Termination
You may stop using the Service at any time. We may suspend or terminate access if you materially breach these Terms, if required by law, or to protect the Service or other users. Provisions that by their nature should survive will survive termination.
13. Governing law and disputes
These Terms are governed by the laws of the State of Delaware, USA, excluding conflict-of-law rules, unless mandatory consumer protection laws in your jurisdiction provide otherwise. Courts in Delaware shall have exclusive jurisdiction, subject to mandatory rights you may have in your country of residence.
14. Changes
We may update these Terms from time to time. We will post the revised Terms and update the "Last Updated" date. Material changes may require additional notice where required by law. Continued use after changes become effective constitutes acceptance.
